Wecheer Platform Terms & Conditions (GTC)

Who we are. Wecheer SA (“Wecheer”, “we”, “us”). Registered office: Avenue Victor‑Ruffy 5, 1012 Lausanne, Switzerland. Contact: Support@wecheer.io These GTC govern your use of our website, mobile apps and loyalty platform (the “Platform”).

What we do. We provide an intermediary Platform that connects brands/advertisers (each an “Advertiser”) with eligible users (“Users”) for loyalty, incentives and promotional programs (each a “Program”). Wecheer does not create, sponsor, or fulfill Advertiser Programs and is not a party to the contract between you and an Advertiser.

1. Acceptance & Scope

By creating an account or using the Platform or webiste, you agree to these GTC and our Privacy Policy. If you join a Program, you must also accept the Advertiser’s program terms and any third‑party reward provider terms. If any Program terms conflict with these GTC, those Program terms govern your participation in that Program and these GTC govern your use of the Platform otherwise.

The Platform is offered worldwide. Certain features or rewards may be restricted by local law, age limits, or availability.

2. Eligibility & Accounts

  • You must be 18+ and capable of forming a binding contract.
  • One account per natural person. Accounts are non‑transferable.
  • Keep your login credentials/OTP secure; you are responsible for all activity on your account.
  • We may refuse, suspend, or close accounts to protect Users, Advertisers or the Platform (e.g., suspected fraud, policy breaches, unlawful use).
  • Certain Programs or categories (e.g., alcohol or other age‑restricted products) may impose stricter age or eligibility rules depending on market and Advertiser requirements; verification (such as age checks, geofencing or ID) may be required by the Advertiser and/or Wecheer.

3. Joining Programs

  1. Opt‑in. Users opt in to join a Program proposed by an Advertiser.

  2. Program responsibility. Advertisers are fully responsible for their Programs, including eligibility rules, actions required, rewards offered, and Program terms disclosed in the Program page.

  3. Advertiser terms. You must accept the Advertiser’s T&C (and any reward supplier terms) to participate.

  4. Data sharing. We share your data only with the Advertiser(s) you opted into, and only as described in our Privacy Policy.

  5. Opt‑out. You can leave a Program or manage communications at any time (see Section 10 and the Privacy Policy).

  6. Program changes. Advertisers may adjust or change Program mechanics (including eligible actions, reward values, caps and timelines) to ensure fairness, compliance, or operational continuity. Material changes will be reflected in the Program page and may require you to re‑accept terms where required by law. Already‑earned rewards will be honored unless obtained in breach of these GTC or the Program terms.

4. Earning (“Earn”) & Proof of Action

Programs may allow earning points/stamps/rewards by: – Receipt scanning (must be a valid purchase receipt for participating products within the Program period and showing required details); – QR code scanning (unique codes; do not share); – Unique link (personalized links tied to your account); – Connected devices or games where applicable; – Surveys and research tasks (e.g., completing questionnaires in-app); – Photo/picture training and verification tasks (e.g., taking or labeling photos as instructed); – Other earn and capture tools that Wecheer or Advertisers may introduce and describe in the Program.

Anti‑fraud & misuse. Each valid receipt/QR/link or action may be used once per Program. Any suspected or detected fraud, manipulation, falsification, code/receipt sharing, automated activity, gaming the system, or broader misuse of the Platform may be investigated by Wecheer and/or the Advertiser. Wecheer and the Advertiser reserve the right—at their discretion—to block or delete accounts, remove all points and rewards, refuse redemptions or participation, and report conduct to relevant authorities. We may use automated and manual tools to detect abuse. Our decisions are without prejudice to your legal rights.

5. Redeeming (“Redeem”)

Reward categories may include: (a) digital vouchers/codes or links; (b) in‑person redemptions at listed locations via a Wecheer redemption QR code; (c) game‑based rewards determined by your score or achievement.

  • You must have a complete profile and accept the applicable Advertiser/third‑party reward supplier terms before redemption.
  • No cash alternative unless required by law. Once redeemed, rewards are final and cannot be re‑credited.
  • Wecheer is not responsible for reward quality, availability, fulfillment, or defects—these are handled by the Advertiser or reward provider. Contact details are provided in the Program page.

6. Prohibited Uses

You will not: (a) use the Platform unlawfully or to violate others’ rights; (b) upload or submit false, misleading, or infringing content; (c) interfere with security or integrity of the Platform; (d) reverse engineer or copy the app except as permitted by law; (e) use bots, scripts, or automated methods to accrue benefits.

7. App Licence & IP

We grant you a personal, revocable, non‑exclusive, non‑transferable licence to use the app in object code form solely to access the Platform. All IP in the Platform remains with Wecheer and its licensors. Do not copy, adapt, decompile or create derivative works except where permitted by mandatory law.

8. Availability & Changes

We may change, suspend, or discontinue any feature without notice. We do not guarantee uninterrupted or error‑free operation. Information may be updated without notice.

9. Fees & Taxes

Wecheer does not charge Users fees for basic Platform access. Advertisers may fund Programs. ****Taxation of rewards** (if any) is the Advertiser’s and/or User’s responsibility, including any reporting or withholding obligations under applicable law. Wecheer is not responsible for tax treatment and does not provide tax advice.

10. Communications, Opt‑Out & Account Deletion

  • Manage push/message/email notifications in‑app or via provided unsubscribe links.
  • You may leave a Program in‑app or as instructed in Program terms. After you leave, Wecheer stops sharing your data with that Advertiser (subject to legal/contractual retention described in the Privacy Policy).
  • Delete account: request deletion in‑app or via email. Deleted accounts enter a 30‑day dormant state during which you can reactivate your account. After 30 days, your account is permanently deactivated and personal data is deleted or anonymized unless retention is required by law (see Privacy Policy). During dormancy, access and processing are limited to safety, fraud prevention, and processing pending legal/financial obligations.

11. Third‑Party Services & Links

Programs may involve third‑party services (e.g., reward providers, maps, payments, analytics). Those services are governed by their own terms and privacy policies.

12. Warranties & Liability

The Platform is provided “as is”. To the maximum extent permitted by applicable law, Wecheer disclaims all warranties (express or implied) and is not liable for (a) Program terms, rewards, or fulfilment by Advertisers or reward providers; (b) indirect, incidental, or consequential damages; (c) loss of data, profits, or goodwill; except for liability that cannot be excluded under mandatory law (e.g., willful misconduct, gross negligence, death or personal injury).

13. Suspension & Termination

We may suspend or terminate your account for breach or risk to Users/Advertisers/Platform. You may cancel at any time via in‑app controls or by email. Sections that by nature should survive (e.g., IP, liability limits) will survive termination.

14. Governing Law & Disputes

These GTC are governed by Swiss law (without regard to conflict‑of‑laws rules). The exclusive place of jurisdiction is Lausanne, Switzerland, subject to mandatory consumer protection provisions that may grant you the right to bring claims in your country of residence. These GTC are provided only in English; any translation is for convenience and the English version governs.

15. Changes to these GTC

We may update these GTC to reflect legal, technical or business changes. We will post the updated version with the effective date. Material changes will be notified via the app/website or email where possible. Continued use after the effective date constitutes acceptance.
